Lists are licensed solely on a limited, non-exclusive, non-transferable basis solely for a one time use with an approved offer, and may not be duplicated, reproduced or transferred without Alloy Media + Marketing’s prior written authorization. Unauthorized use of lists will be subject to additional billings and/or damages. Title to and all proprietary rights and goodwill in the Lists at all times vest exclusively in Alloy. No property rights in the Lists are acquired by the customer by reason of its use of the Lists and if, by operation of law, or otherwise, a customer is deemed to or appears to own any property rights in the Lists, the customer shall, at Alloy Media + Marketing’s request, execute any and all documents necessary to confirm or otherwise establish Alloy Media + Marketing’s rights in the Lists.
Normal production time requires two to four working days from the date Alloy Media + Marketing receives the order until it is shipped. Please call to verify ship dates or the status of customer’s order.
Lists are available for unlimited usage for one year from the date of purchase for an additional fee. All Alloy Media + Marketing Lists are seeded with decoy names to ensure against unauthorized use.
New customer accounts require prepayment by check or credit card with their initial orders. A completed credit application, including both bank and trade references, is required to establish credit. Once credit is established, terms are net/30 days. Visa, MasterCard and American Express are also accepted.
Lists are continually being updated. All counts provided are estimates and may vary from the actual order. Therefore, Alloy Media + Marketing cannot be responsible for shortages or overruns of lists or mailing pieces due to such changes.
Sample mailing piece is required for approval prior to shipping order. Alloy Media + Marketing shall have the right to receive copies of any mailings delivered by customer prior to such delivery.
Shipping is billed at cost plus handling. All List orders are shipped UPS 2-Day service unless otherwise specified by the customer.
Orders which are cancelled prior to the initial mail date are subject to a $50 flat fee plus $10/M run charges, applicable selection charges, output and shipping. After the mail date, full charges apply.
